Welcome to CommonsFairmarket ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services and the website found at commonsfairmarket.sbs (the "Service") operated by CommonsFairmarket.
By reserving a charter or using our Service, you consent to adhere to these Terms. Should you not accept any portion of these terms, you are prohibited from using the Service.
2. Service Overview
CommonsFairmarket offers deluxe yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Our services are provided based on availability and conducive weather conditions. We retain the right to alter or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, you must:
- Be at least 18 years old
- Provide truthful and complete details
- Remit the necessary deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is considered confirmed only after we have received payment and provided a written conformation. We reserve the right to decline service to any person at our own discretion.
3.3 Availability
Charting is dependent on the availability of the vessel and favorable weather conditions. We will endeavor to meet your preferred dates and times where feasible.
4. Payment Terms
4.1 Pricing
All rates are indicated in £ and incorporate applicable taxes unless otherwise stated. We may alter prices without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the overall charter fee required at the time of reservation
- Remaining Balance: Due 48 hours prior to the charter's departure
- Additional expenses (if any): Due after the charter is completed
4.3 Payment Methods
We accept major credit cards, wire transfers, and certified cheques. Our payment processing is secured with encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Complete refund excluding processing fees
- 24-72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
If the captain determines the weather conditions unsafe, we will propose to:
- Schedule your charter for another available date without any extra charge
- Issue a full refund if rescheduling is impractical
5.3 Mechanical Issues
Should there be mechanical issues with the designated vessel, we will try to offer an appropriate substitute. If an alternative is not available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all directives from the crew
- Wear compulsory safety gear when mandated
- Disclose any medical conditions that may impact their safety
- Remain within the permitted areas of the vessel
6.2 Prohibited Items
The following articles are not allowed on board:
- Glass containers
- Illegal substances
- Arms or other weapons
- Excessive amounts of beverages (beyond moderate consumption)
- Pets (unless pre-authorized)
6.3 Conduct
Travelers must maintain a respectful demeanor. We reserve the privilege to end a charter prematurely without a refund if the conduct of a passenger poses a threat to safety or interferes with the experience of other guests.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the cost paid for your charter. We assume no responsibility for:
- Personal injuries caused by passenger recklessness
- Personal property loss or damage
- Indirect or punitive damages, or consequential losses
- Postponements due to weather or circumstances out of our control
7.2 Insurance Coverage
We carry extensive marine insurance that protects our fleet and operations. Passengers are in charge of their own personal and travel insurance.
7.3 Assumption of Risk
Engaging in our charter activities signifies that you recognize the inherent risks of maritime activities and assume responsibility for your safety and well-being.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, paths, or timetables because of weather conditions, safety concerns, or operational needs. We will make all attempts to provide a comparable alternative experience.
9. Force Majeure
We cannot be held liable for interruptions, cancellations, or alterations resulting from factors outside our control, such as but not confined to:
- Extreme weather events
- Natural catastrophes
- Governmental edicts
- Harbor shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your personal details are processed in accordance with our Privacy Policy. By utilizing our services, you give permission for the collection and use of your data as outlined in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as text, imagery, logos, and graphics, are protected by copyright and trademark laws. Unauthorized reproduction, distribution, or the creation of derivative works is not permitted without our explicit consent.
12. Governing Law
These Terms are subject to the laws applicable in United Kingdom. Any disputes shall be adjudicated in the courts located in Southampton, United Kingdom.
